Can I get divorced in Australia if I was married in Russia?
Yes. You do not need to return to Russia to end your marriage. As long as you or your spouse meet one of the following criteria, the Australian court system has the jurisdiction to grant your divorce:
- You are an Australian citizen.
- You live in Australia and regard it as your permanent home.
- You ordinarily live in Australia and have done so for at least the 12 months immediately preceding your application.
The “12-Month Separation” Rule
In Australia, the only ground for divorce is the “irretrievable breakdown” of the marriage. This is proven by a mandatory 12-month and 1-day separation period.
Important Note: Separation Under One Roof Due to the high cost of living or family reasons, many couples continue to live in the same house after they have “separated.” Australian law allows for this. However, you will need to provide the court with an affidavit (and a supporting statement from a third party, such as a friend or neighbor) to prove that you were leading separate lives during that time.
Australia is a “No-Fault” Jurisdiction
Unlike some older legal systems, Australia has a “no-fault” divorce policy. This means the court is not interested in why the marriage ended. Whether there was infidelity, incompatibility, or simply a change of heart, the court does not assign blame. This simplified approach is designed to reduce conflict and focus on the legal dissolution of the union.
The Russian Marriage Certificate: Translation & Affidavits
To apply for a divorce, you must provide the court with your marriage certificate. If your certificate is in Russian, it must be translated into English by a NAATI-certified translator.
However, a simple translation is not enough for the Federal Circuit and Family Court of Australia. You must also file an Affidavit of Translation. This is a legal document where the translator swears that the translation is accurate and confirms their professional credentials.

Serving Documents if your Spouse is in Russia
If you file a “Sole Application” (where you apply for the divorce alone), you are legally required to “serve” the documents to your spouse. This can be complicated if they have moved back to Russia.
- Service by Post: You can mail the documents to Russia, but you must receive a signed “Acknowledgment of Service” back from your spouse.
- Service by Hand: You may hire a process server or a third party in Russia to hand-deliver the papers.
Substituted Service: If you cannot locate your spouse or they refuse to sign, you can apply for “Substituted Service.” This allows you to serve them via email, social media, or even through a relative, provided you can prove to the court that this method will effectively bring the divorce to their attention.
